A DUI conviction in Illinois means you will need to file for an SR-22. An SR-22 is a certificate of financial responsibility and is verification that you carry “high risk” auto-insurance. You need to maintain an SR-22 for three years following a DUI-related license suspension to show the state of Illinois that you have proof of liability insurance.
Here’s the steps that you need to take to obtain your SR-22 in Illinois.
Filing for an SR-22 in Illinois
First, you must contact an insurance company that is authorized to write SR-22 policies in Illinois. This could be your current auto-insurance provider, but if not, you will need to search for another provider. When you have a provider, they will go over next steps with you. The SR-22 is submitted as a Financial Responsibility Certificate from your insurance company.
Once your certificate is processed by your insurance company, they will send your certificate to the Secretary of State (SOS). Their average processing time is up to 30 days. The SOS will send you a copy of your SR-22 and a letter for your files.
Keep in mind that your insurance company is obligated by law to notify the SOS if your SR-22 is cancelled or expires.
When Should I File for an SR-22?
An SR-22 can take up to 30 days or more to process. Individuals who need a Monitoring Device Driving Permit (MDDP) should file for an SR-22 right away. If you are applying for a Restricted Driving Permit (RDP), you need to file for an SR-22 about 60 days prior to receiving your RDP. You may also need to provide proof of your SR-22 when your driver’s license is reinstated. Be sure to ask an Illinois SOS representative prior to applying for the restoration of your driving privileges.
Once you have your proof of an SR-22 and a valid driving permit or license, you’ll be back on the road.
