The new Colorado DUI law, Alcohol Monitoring for Impaired Driving Offenders or SB22-055, makes the following changes:
Immediate License Reinstatement
Instead of having a mandatory one-month license suspension, SB22-055 grants immediate license reinstatement with an interlock-restricted license. An interlock-restricted license permits you to drive a vehicle only if it is equipped with an Ignition Interlock Device (IID). Learn more about interlock-restricted licenses here.
This means those convicted of a DUI can have an Ignition Interlock Device installed immediately. Fill out the form below to get a quote or call (800) 831-3299 to get started on this process today!
Alcohol Monitor Requirement
The new Colorado DUI law also requires 90 days of continuous sobriety monitoring for people sentenced to probation following a third or subsequent offense, or a felony offense, for DUI, DUI per se, or DWAI. This means those sentenced will be required to wear an ankle monitor. This unit is a condition of release on probation and would be effective once the convicted individual is on probation.
These changes only apply to convictions after January 1st. It does not apply to any convictions before this date since this bill does not have a retroactive period.
About the Bill
Congressmen John Cooke, Chris Hansen, Dylan Roberts, and Hugh McKean were the prime sponsors of the Bill. Though the bill was approved on June 8th, 2022, it didn’t go into effect until January 1st, 2023.
Senator Cooke, a retired sheriff for Weld County told Colorado Newsline that he believes this law is making it safer to drive after a DUI. “This is a way to reliably ensure that people who have DUI convictions or pending DUI cases are only driving if they’re sober.”
Colorado Ignition Interlock
According to the CDC, Ignition Interlock Devices reduce repeat DUI offenses by 67%. Mothers Against Drunk Driving (MADD) Colorado says interlock devices stopped 15,365 attempts to drive drunk in Colorado in 2020.
